CONCERNING
REQUIREMENTS FOR THE IMPORTATION INTO THE TERRITORY
OF THE REPUBLIC OF INDONESIA OF PLANT PROPAGATING MATERIALS

THE MINISTER OF AGRICULTURE,

Considering:

• a. that through Decree of the Minister of Agriculture No. 431/Kpts/Um/7/1977 as amended by Decree of the Minister of Agriculture No. 22/Kpts/Um/1/1978, the Minister of Agriculture has promulgated the requirements for the importation the territory of the Republic of Indonesia of plant propagating materials;
• b. that the increase of imports of plant propagating materials at present necessitates a better formulation of the requirements for the importation of plant propagating materials so that the quality of plant propagating materials to be imported can be ensured;
• c. that based on the above mentioned facts it is deemed necessary to amended the requirements for importation the territory of the Republic of Indonesia of plant propagating materials.

• 5. Decree of the President of the Republic of Indonesia No. 45/1974 as amended by Decree of the President of the Republic of Indonesia No. 24/1983;
• 6. Decree of the President of the Republic of Indonesia No. 45/M/1983;
• 7. Regulation of the Minister of Agriculture No. 7/PMP/1961;
• 8. Decree of the Minister of Agriculture No. 460/Kpts/Org/11/1971;
• 9. Decree of the Minister of Agriculture No. 461/Kpts/11/1971;
• 10. Decree of the Minister of Agriculture No. OT.210/706/Kpts/9/1983.

Observing:

Proposal of the National Seed Board in its letter No. 921/BBN/XI/1983.

HAS DECIDED

To Stipulate:

DECREE OF THE MINISTER OF AGRICULTURE ON THE REQUIREMENTS FOR IMPORTATION INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA OF PLANT PROPAGATING MATERIALS.

Article 1

Any importation into the territory of the Republic of Indonesia of plant propagating materials shall be made only after a permit has been issued the Minister of Agriculture.

Article 2

The quantity of the plant propagating materials to be imported shall be determined by the Minister of Agriculture.

Article 3

(1) The importation of plant propagating materials for research purposes shall be made only by the Agency for Agricultural and Development;

(2) The Minister of Agriculture may, in certain case, give permission to private organizations to import plant propagating materials for research purposes;

(3) The research by the private organization referred to in Paragraph (2) of this Article shall be conducted under the supervision of the Agency for Agricultural Research and Development.

Article 4

The importation of plant propagating materials for direct use as planting materials in the field shall be allowed only if:

• a. the species/variety/hybrid/clone has ever been released for propagating by the Minister of Agriculture or has been widely planted by the farmers;
• b. the Agency for Agricultural Research and Development and the Directorate-General concerned have ever declared that the production of the plant propagating materials, on ac-count of certain considerations both technical and non-technical, cannot be carried out in the territory of the Republic of Indonesia;
• c. the plant propagating materials to be imported meet the minimum standards of quality to be set later by the Directorate-General concerned;
• d. the following information is known for a certainly:
• - Ename of producer;
• - Eexporting country;
• - Ecountry/ place of origin of plant propagating materials produced;
• - Ename of the species;
• - Ename of the variety/hybrid/clone;
• - Echemical or physical treatment given;
• - time or harvest of the plant propagating materials in the form of seeds or tubers/bulbs.
• e. each container of the plant propagating materials is to be affixed thereto a label which can-not be easily damage or removed and which is readily visible. The label shall contain the information as mentioned in point c and d this Article written in Indonesian to English.

Article 5

The supervision of the implementation of Article 4 point c, d and e shall be performed by the agency appointed by the Directorate-General concerned.

Article 6

For the performance of the provisions of Article 5 the person/body importing the plant propagating materials shall submit a notice of arrival of the plant propagating materials stating amongst other the quantity, date and place of arrival and means of conveyance, to the agency appointed by the Directorate-General concerned at least one week prior to the arrival of the plant propagating materials.

Article 7

Any importation of plant propagating materials shall comply with the plant quarantine regulations.

Article 8

Requests for permits to import plant propagating materials shall be submitted in writing by filling in an application from to the Minister of Agriculture through the National Seed Board.

Article 9

After consulting the Chairman of the National Seed Board, the Minister of Agriculture may accept or reject the application for permit to import plant propagating materials.

Article 10

If considered necessary the Minister of Agriculture may give permission to import plant propagating materials not withstanding the provisions of this Decree with due observance of the plant quarantine regulations.

Article 11

By the issuance of this Decree all previous governing to importation into the territory of the Republic of Indonesia of plant propagating materials declared invalid.

Article 12

Subject not covered adequately by this Decree shall be stipulated later.

Article 13

This Decree shall come into effect on the date of issuance.
